PARKER, Umpire, rendered the decision of the Commission.
This case is before the Umpire for decision on a certificate of the American Commissioner and the German Commissioner[a] certifying their disagreement.
The United States on behalf of Dorothy Conner Dugger asserts this claim based on facts as disclosed by the record as follows:
Dorothy Conner, then unmarried, about 25 years of age, who was born and has always remained an American citizen, was a passenger on the Lusitania at the time of its destruction. She was thrown into and for a short time held under the water, losing consciousness. Artificial respiratory methods were successfully applied after she had been picked up, first on a raft and then transferred to another raft and thence to a mine destroyer. She suffered from numerous contusions and shock producing a neurasthenic state, continuing in varying degrees for some five or six years. She had a weakened dilated heart. Prior to this harrowing experience the claimant was physically strong, frequently engaged in numerous athletic sports, and was active and alert in mind and body. She was a college graduate and is also a graduate from a secretarial school, and had planned to undertake secretarial work or to secure a position as a teacher. She was for several years prevented from pursuing any gainful occupation because of her nervous condition. On June 4, 1923, claimant married Greene Williams Dugger, an officer in the United States Navy, who was born and has always remained an American citizen.
The personal effects lost by claimant in the sinking of the Lusitania were of the value of $2,160.00.
Applying the rules announced in the Lusitania Opinion and other decisions of this Commission to the facts in this case as disclosed by the record, the Commission decrees that under the Treaty of Berlin of August 25, 1921, and in accordance with the terms of the Government of Germany is obligated to pay to the Government of the United States on behalf of Dorothy Conner Dugger the sum of ten thousand dollars ($10,000.00) with interest thereon at the rate of five per cent per annum from November 1, 1923, and the further sum of two thousand one hundred sixty dollars ($2,160.00) with interest thereon at the rate of five per cent per annum from May 7, 1915.
