Docket No. 2052: Isabelle Hamilton

Docket No. 2052.

UNITED STATES OF AMERICA
on behalf of
John Hamilton, individually and as Administrator of the Estate of Isabelle [sic] Murrhead Hamilton, Deceased,
Claimants,

v.

GERMANY.

BY THE COMMISSION: –

Isabelle [sic] Murrhead Hamilton, wife of the claimant John Hamilton, was lost with the Lusitania. She left surviving her husband, three daughters, and four sons, all of whom were at that time and some of them whom still are British subjects. The claimant John Hamilton, through naturalization, subsequently became an American citizen on December 30, 1915. The personal property belonging to the deceased which was lost with her was impressed with her British nationality. It appears from the record that no American national suffered damages, through the death of the deceased, which can be measured by pecuniary standards.

Applying the rules heretofore announced in the Lusitania Opinion, in Administrative Decision No. V, and in the other decisions of this Commission to the facts as disclosed by this record, the Commission decrees that under the Treaty of Berlin of August 25, 1921, and in accordance with its terms the Government of Germany is not obligated to pay to the Government of the United States any amount on behalf of either of the claimants herein.

Done at Washington January 7, 1925.

EDWIN B. PARKER,
Umpire.

CHANDLER P. ANDERSON,
American Commissioner.

W. KIESSELBACH,
German Commissioner.
